THE PROGRAM:  The US Government protects virtually every American worker against disability through the Social Security disability insurance program (SSDI, for short).  If you worked, you automatically had mandatory FICA tax withheld from your pay.  If you worked enough, you got covered by SSDI.

THE PARTICULARS:  To receive benefits when you become unable to work due to a physical or mental illness, you must apply and meet very strict requirements.  
  • Be medically unable to work for at least 12 consecutive months
  • Have a medically determinable severe impairment
  • Not currently be working at substantial gainful activity (SGA)
  • Have medical treatment (records) to prove the severity of your medical condition.  We can help you get those records if they exist.
Claimants who are age 55 or over have the easier time being approved.  This is because they are not able to adjust to new work or types of jobs besides the ones in which they have experience.  (These claimants will often need an appeal, however, to win).

Claimants under age 50 may be approved for severe impairments, but only if they can medically demonstrate that they are not able to work at ANY full-time job, even sedentary unskilled jobs.

There is no such thing as partial disability with Social Security.  A person is either totally disabled, or not disabled at all.  So, you will get a full benefit or no benefit at all.  The amount of your monthly benefit depends on how long you worked and how much you earned.

You may claim payments from Social Security for at least 1 year prior to your application.  This is called "back pay."  For example, if you had a heart attack on June 1, 2015 that left you permanently disabled but you didn't file an appliation until June of 2016, you can ask for "back pay" going back to June, 2015. There is, however, a mandatory 5-month "waiting period" or elimination period.  Social Security will not pay a benefit for the first five months of a disability under Title II.  (The SSI program uses a different rule). 

About 75 percent of disability claims will be denied and will  require an appeal before they can be paid.  In this case, the claimant actually appears before an administrative law judge (ALJ), explains his case and how he meets the requirements for a benefit.  Most claimants are represented by an attorney or professional advocate at these hearings.

If your claim is denied, we will immediately file an appeal at no cost to you.  No deposits, no retainers, no money up front. There will be no fee unless you are approved and collect back pay or past due benefits.

We will prepare your case for hearing and attend the hearing with you, asking for maximum back pay and benefits for you.

If your case is favorably decided, we will ask Social Security to pay the fee that you and we have agreed upon--based on a small percentage of the back pay that you get.  If you do not collect any back pay, we will not ask for a fee and you owe us nothing. We put that in writing and it is also back up by Social Security rules.
